1. Acceptance of Terms

By accessing or using SurveySally ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

SurveySally is a cloud-based survey platform that enables organisations ("Tenants") to create, distribute, and analyse surveys. The Service includes the survey creation portal, survey respondent interface, analytics dashboard, and related APIs.

3. Accounts and Registration

To use the Service as a Tenant, you must register using Google or Microsoft single sign-on. You are responsible for maintaining the security of your account and for all activities under your account. Tenant accounts require approval by SurveySally administrators before activation.

4. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes or to collect information unlawfully
• Distribute malware or harmful content through surveys
• Attempt to access other tenants' data or circumvent security measures
• Use automated tools to scrape or overload the Service
• Create surveys that collect sensitive personal information without appropriate consent
• Impersonate others or misrepresent your affiliation

5. Survey Content

Tenants are solely responsible for the content of their surveys, including questions, images, and videos. SurveySally does not review survey content but reserves the right to remove surveys that violate these terms or applicable law.

6. Data Ownership

Tenants retain ownership of their survey designs and response data. SurveySally retains the right to use aggregated, anonymised data for service improvement and analytics. Survey response data belongs to the Tenant who created the survey.

7. Intellectual Property

The SurveySally name, logo, and platform code are the intellectual property of SurveySally. Tenants may not reproduce, modify, or distribute any part of the Service without written permission.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance that temporarily affects availability. We will provide reasonable notice for planned maintenance when possible.

9. Pricing and Payment

Free tier features are provided at no cost. Paid features are billed according to the pricing displayed on our website. We reserve the right to modify pricing with 30 days' notice. All prices are in South African Rand (ZAR) unless stated otherwise.

10. Suspension and Termination

We may suspend or terminate a Tenant account if:

• The Tenant violates these Terms
• The Tenant's payment is overdue
• The account poses a security risk
• Required by law

Tenants may close their account at any time. Upon closure, all data will be deleted within 30 days.

11. Limitation of Liability

To the maximum extent permitted by law, SurveySally shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of South Africa.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email to registered Tenants. Continued use of the Service after changes constitutes acceptance of the updated Terms.
